Application is different from registration

Filing creates an application that is examined by the Trade Marks Registry. It does not itself mean that the mark has been registered. Examination, response to objections, publication, opposition and other steps may arise according to the application. Approval cannot be guaranteed.

Before filing: mark, owner and class

A useful filing review should answer three basic questions: what mark is being filed, who will own the application, and which goods or services the mark will cover. A word mark and a logo may protect different presentations. The applicant may be an individual or an eligible business entity, but the chosen applicant and supporting documents must be consistent.

Trademark classes group goods and services. A class should be selected from the actual business activity and planned use, not guessed from a similar brand. A business operating across different goods or services may require more than one class.

Information commonly reviewed

  • Proposed brand name or logo
  • Applicant name, constitution and address
  • Description of actual and planned goods or services
  • Claimed-use position and supporting material, where applicable
  • Startup or MSME status where a relevant official category is claimed
  • Authorisation and other documents required for the filing route

Search before applying

A preliminary search can identify identical or similar marks, but it cannot guarantee acceptance or eliminate every conflict. Search results must be read with the relevant class, goods/services description and overall similarity in mind.

Use the official IP India Public Search for current registry data. IP India also publishes a step-by-step filing process.

Government fee and professional fee

The applicable government fee can depend on the applicant category, filing mode, number of classes and current official schedule. Government fees are separate from professional fees. Professional fees are case specific. Current government-fee information should be checked on the official IP India forms and fees page before filing.

Examination and objection support
